A Public Interest Litigation (PIL) has been filed against Wadhwa’s Palm Beach Residency at Nerul. While the Wadhwa project is known as Palm Beach Residency, in government records it’s known as Ameya CHS.
PALM BEACH RESIDENCY WAS BORN OUT OF A CIDCO SCAM
Wadhwa Builder’s Ameya Coop Hsg Society now known as Palm Beach Residency was born out of one of the biggest scams that ever happened in CIDCO when VM Lal was CIDCO MD and the state Chief Minister was Sushil Kumar Shinde. It was in the year 2004, that CIDCO allotted 37,000 sq meters plot to six dummy housing societies in the name of housing for Mathadis. These were amalgated into one society that is now the “Ameya Coop Hsg Soc.” The allotment was challenged in court by Public Concern for Governance Trust, founded by cabinet secretary B G Deshmukh. In the PIL, the HC lashed out at CIDCO officials and cancelled the allotment. A division bench of Justice H L Gokhale and Justice Roshan Dalvi at the Bombay High termed the allotment “the most outlandish (attempt) by the builders to grab land under the shroud of housing societies which existed only on paper”. It even questioned the role of the then Chief Minister Sushil Kumar Shinde in pushing the file for approval in CIDCO. However, later Wadhwa developers won the case in Supreme Court and construction resumed on the controversial plot developing the now “Palm Beach Residency” at the entrance of Nerul.
PALM BEACH RESIDENCY IS ILLEGALLY OCCUPIED
Perhaps getting away with a land scam is the reason why 14 years later the Wadhwa Group’s Palm Beach Residency is built and its over 650 flats occupied but has illegal construction and major violations due to which it continues to be denied OC. NMMC Commissioner Dr Ramaswamy N confirmed that Wadhwa Group’s Palm Beach Residency does not have a OC.
In reply to a RTI filed by journalist and activist Kishor Singh in March 2018, the NMMC informed the following violations at PBR’s Ameya CHS due to which it has been denied OC. This includes :
Wadhwa Group did not obtain CIDCO NOC
Illegal construction and major violations have been made between plan submitted at time of obtaining CC from NMMC and the actual construction done on ground
- Wadhwa Group did not obtain NMMC Property Tax NOC
- Wadhwa Group did not obtain NMMC Fire NOC
- Wadhwa Group did not obtain NMMC Health Committee NOC
- Violations in pent house & commercial construction
“PALM BEACH RESIDENCY WILL NEVER GET OC”
According to RTI activist Kishor Singh, the project does not have a single NOC. He said that NMMC sources have informed him that the PBR will never get OC due to major violations. Kishor Singh questions that if a fire took place at the tower, who would be responsible.
PIL FILED IN HIGH COURT AGAINST ILLEGAL OCCUPANCY AT PALM BEACH RESIDENCY
A PIL has now been filed against the illegal occupancy at PBR’s Ameya CHS. The petitioner Sandeep Thakur says that once he found out that the society had no OC, he filed a case against Ameya CHS.
ARCHITECT HITEN SETHI’S ROLE UNDER SCANNER
Sandeep Thakur said that his PIL appeals action against builders, the architect and citizens occupying PBR’s Ameya CHS. The case of major violations at Wadhwa Group’s Ameya CHS has also brought the role of its architect Hiten Sethi under scanner. Allegedly his firm committed fraud by submitting a false letter in NMMC. According RTI activist Rajeev Mishra, it’s the architect that plays the agent between town planning and builders to cover up violations.
