In nearly 5 years as Chief Minister, Devendra Fadavnis holds a clean record. No allegations of corruption, no scams and so far no accusations of any nexus with powerful builders in the state. This has been an achievement for him as a Chief Minister. However, a PIL by eminent RTI activist Sandeep Thakur in the Bombay High Court challenges this clean record of Chief Minister Devendra Fadavnis. The PIL in question is against Nerul situated Wadhwa Group’s Amey CHS.
WADHWA GROUPS’ PALM BEACH RESIDENCY AMEY COOP HSG SOC IS ILLEGAL
The case in Bombay High Court brings on record that Wadhwa Group’s Amey CHS does not have an Occupancy Certificate. On one hand the group’s Chairman Vijay Wadhwa and Managing Director Navin Makhija speak of following ethical practices as a builder group, on another hand they have made sold even fire refuge areas in their project at Nerul to make money from ignorant buyers. Without Occupancy Certificate, the flats have been sold to the tune of Crores and the architect of the project Hiten Sethi too lives in the same building.
Here is a list of the violations committed by Wadhwa Group in the project :
- The construction has not been done as per approved plan.
- Fire refuge area also not spared to make money.
- Besides these there are several violations, some committed by the architect Hiten Sethi in his own pent house in the same project. The violations are so many and such that NMMC can never regularize them.
CHIEF MINISTER DEVENDRA FADAVNIS SHIELDING WADHWA GROUP?
The most shocking expose in the case has been made by the petitioner Sandeep Thakur in the Bombay High Court where he has brought on record that the Principal Secretary of the Chief Minister’s Office has been pressurizing NMMC on OC to Wadhwa Group.
He added that he has brought on record in the Bombay High Court, the interference of the CMO in the case.
BOMBAY HIGH COURT DEMANDS REPLY FROM BUILDER ON MARCH 22ND
The fate of Wadhwa Group’s Palm Beach Residency Amey CHS will be decided on March 22nd when the case will be heard next. Sandeep Thakur says that he has appealed to the court to order that flats be vacated in the project, violations should be demolished and action should be taken against both NMMC officials and architect Hiten Sethi.
It may be recalled when NMTV has spoken to NMMC Commissioner Dr Ramaswamy N he had said that they rejected the OC to Wadhwa Group in November 2018.
The NMMC is all set to expose the violations of the builder and architect during the hearing of the case in Bombay High Court.
“BLACKLIST AND JAIL THE BUILDER”
Sandeep Thakur advocates that such builders, who put the lives of citizens at risk if an untoward incident of a fire ever occurred, should be jailed and blacklisted.
According to sources, post this PIL, Wadhwa Group is facing the heat of aware buyers who have pulled back from investing in its project Wise City at Panvel next to Navi Mumbai International Airport. The project, one may recalled was launched by Chief Minister Devendra Fadavnis with much fanfare last year. It’s unfortunate that a Chief Minister of the repute of Devendra Fadavnis is aligning his clean record with the unethical work by Wadhwa Group. As for Wadhwa Group, they often speak of the highest standards of ethical building. Unfortunately, the Wadhwa Group does not seem to be walking its talk in its Nerul project. Meanwhile since the life-savings of many ignorant buyers stands at risk, it will be a wait and watch on the Bombay High Courts’ stand on it. This PIL is extremely crucial also because it will hopefully bring an end to the dangerous trend of unethical builders selling flats illegally to ignorant buyers.
